Europe’s drive to implement the Markets in Crypto Assets (MiCA) regulations is not just a matter of obtaining licenses but emphasizes a shift toward sustainable compliance, compelling crypto enterprises to reconsider their operational strategies and partnerships.

With MiCA in effect, European crypto entities are transitioning to a period marked by strategic mergers and collaborations, intertwining with established financial institutions. This scenario is set to demand more than just regulatory approval, pushing companies to upscale in order to meet increasingly stringent compliance norms.

In the UK, the Financial Conduct Authority (FCA) is crafting new rules that echo the EU’s rigorous MiCA standards, potentially aligning the regulatory treatment of crypto firms with that of traditional financial bodies. Unlike the bespoke MiCA framework, the UK’s proposal aims to integrate these firms into existing financial regulations.

The FCA is trying to help competition and newcomers, but it enforces very high standards, especially where consumers are concerned, Lightstone explained.

Are Banks the Ultimate Beneficiaries?

Indeed, the new regulatory phase could favor established banks and financial institutions, already adept at managing comprehensive compliance systems. Meanwhile, nascent crypto startups may struggle to establish the necessary governance, financial strength, and asset custody frameworks, which could lead to increased operational complexities and costs.

Regulatory frameworks like the Clients Asset Sourcebook (CASS) may require these entities to segregate client assets, coupled with stringent controls over digital asset management—a potentially burdensome requirement that might drive these startups toward partnerships with experienced financial institutions.

Banks are beginning to explore new opportunities to expand their crypto service offerings. Simon Schneider, CEO of Sygnum Europe, pointed out that while few European banks currently provide crypto services, legal frameworks like MiCA could enhance their willingness to do so.

There is less than 20% of all the banks in Europe offering any type of crypto services, so it’s heavily underserved, Schneider observed.

Schneider believes that MiCA’s primary effect lies in delivering legal clarity for traditional banks, promoting a rapid adoption of digital financial services similar to Switzerland’s success following its introduction of blockchain regulations. Sygnum positions itself as a provider of regulated infrastructure, anticipating a symbiotic relationship with financial institutions aiming to incorporate crypto offerings into their portfolios.

The UK’s regulatory framework brings a challenge to startups, which may necessitate scaling as regulatory costs rise. This could lead to increased consolidation as larger companies in the sector successfully navigate the complex regulatory landscape.
