South Korea may once again delay its planned tax on cryptocurrency gains, now potentially pushed back to 2029. Reports indicate that the presidential office is warming to the idea of postponing the regulation, originally set to take effect on January 1, 2027. Under this scenario, investors in the country might not begin paying taxes on digital asset earnings until after 2029.

Potential Fourth Delay in Crypto Tax Implementation

The current legislation proposes a 22% tax on annual cryptocurrency gains exceeding 2.5 million won, encompassing a 20% income tax and a 2% local tax. Though offering a clear framework at first glance, the implementation schedule has been a contentious topic since its inception. Initially approved in 2020 with a planned rollout in January 2022, the timeline was subsequently postponed to 2023, then 2025, and most recently to 2027. Current assessments suggest the new effective date could shift to 2029.

The debated model in South Korea stipulates a 22% tax on crypto gains over 2.5 million won annually, yet discussions around its preparatory timeline could alter the execution date once more.

Key Concerns: Monitoring Foreign Exchange Transactions

Critics, including politicians and industry representatives, contend that South Korea is not yet ready to enforce this system effectively. The primary concern is the difficulty in monitoring transactions conducted through foreign cryptocurrency exchanges. These critics argue that implementing the tax without an adequate international reporting framework may disadvantage local platforms and their users, prompting calls for tax obligations to align with global data-sharing standards.

New Proposal Links Tax Timing to International Reporting

Earlier this month, Democratic Party lawmaker Park Min-kyu introduced a bill that ties the implementation of the crypto tax to international information-sharing agreements. The proposal suggests postponing the tax until two years after the first crypto transaction data sharing under the Organization for Economic Co-operation and Development’s (OECD) Crypto Asset Reporting Framework (CARF).

The OECD is an international organization coordinating economic policies and regulatory standards among member countries. Park Min-kyu’s proposal aims to delay the tax’s commencement until two years after the initial international data sharing within the CARF framework.

U.S. Timeline May Influence South Korea’s Decision

CARF’s primary purpose is to allow tax authorities to better track cross-border crypto transactions. It is expected that the United States will join this system in 2029, potentially limiting South Korea’s access to data from U.S.-based trading platforms until then. This scenario explains the cautious stance of Seoul policymakers concerning the tax’s implementation. Excluding transactions on foreign platforms could lead to imbalanced outcomes in both regulatory oversight and competition.
