The U.S. Securities and Exchange Commission (SEC) is pursuing legal action against the company Mining Automatic and its founder, Zan Shaikh. Accused of securing $22 million from hundreds of contributors, the firm reportedly invested only a fraction of these funds into actual cryptocurrency mining, resulting in significant disparities and unpaid investor principal.

The SEC accuses Mining Automatic of diverting funds, under the operation of Bright Vision Distribution LLC based in Massachusetts. The period from June 2023 to May 2025 saw misleading promises made to over 380 financiers regarding guaranteed profits from mining activities. However, the organization’s business model reportedly fell short in delivering the advertised gains.

A mere 13% of the pooled resources, approximately $1.1 million, went into mining activities, while $1.8 million was disbursed to investors, as per the SEC’s allegations. The inquiry revealed that other funds were funneled into marketing, personal uses, and non-related ventures.

SEC representatives highlighted the scheme’s resemblance to a Ponzi scheme, noting the reliance on new capital to fulfill prior commitments rather than profits from legitimate mining outcomes.

Payments ceased by March 2025, according to reports, leaving the original investors without their initial capital. The lawsuit claims over $20 million remains outstanding.

The watchdog is requesting federal remedies such as restitution of ill-gotten gains, imposing civic fines, and enforcing lasting bans on Shaikh regarding securities sales or executive positions in public companies.
