South Korea is embarking on a significant regulatory overhaul by eliminating the minimum threshold for its crypto Travel Rule. This bold move means that all transactions between registered virtual asset service providers (VASPs) will be subject to strict regulatory compliance, irrespective of the transaction size. This shift follows the South Korean Cabinet’s green light to amendments to the Enforcement Decree of the Act on Reporting and Using Specified Financial Transaction Information.

Indeed, the new legislation mandates that every crypto transaction, no matter its value, must adhere to the Travel Rule. This ends the prior 1 million won (about $700) exemption. Platforms receiving funds are now required to gather comprehensive information about the sender and recipient. Missing data necessitates platforms to either request the necessary information or potentially deny the transaction.

The Financial Intelligence Unit underscored this move’s intention to plug loopholes that allowed users to dodge oversight by splitting transactions. A highlighted case involved an individual funneling large sums into a crypto exchange under the reporting radar by dividing the transactions into smaller parts.

Authorities maintain that the policy shift is essential to prevent users from circumventing regulations by dividing large sums into a series of smaller transactions.

How does this affect international exchanges?

More stringent anti-money laundering (AML) rules are now in play for transfers involving foreign exchanges and personal wallets. Under these amendments, registered local VASPs need to evaluate the risk profiles for all outgoing transactions. Low-risk foreign transactions may proceed, whereas those linked with high-risk entities are barred.

Transfers to or from personal wallets are generally permissible, given the sender and receiver are identical, and platforms are now also required to implement monitoring systems for suspicious transactions exceeding a particular threshold involving foreign exchanges.

South Korean regulators indicated that financial crime involving cross-border exchanges and personal wallets has grown, exploiting gaps in the current AML landscape.
