The city of Albuquerque, New Mexico, has implemented new regulations prohibiting cryptocurrency kiosks, effectively banning the operation of Bitcoin ATMs and cashier-assisted crypto transactions within city limits. This decision marks a significant shift for the city known as the backdrop for popular television series such as Breaking Bad and Better Call Saul.

Immediate Effect of New Regulation

The regulation came into force on October 21, following a city council vote on September 9 where the measure passed with a 6-3 majority. Albuquerque Mayor Tim Keller subsequently signed the decree into law, mandating the immediate deactivation of existing Bitcoin ATMs throughout the city. Operators have been given 45 days from the effective date to physically remove their devices, with non-compliance resulting in daily fines, license revocations, and additional penalties.

Mayor Tim Keller remarked that scammers are persistently innovating ways to defraud individuals, with crypto kiosks having been added to their arsenal.

Fraud and Vulnerable Populations

City officials cite a disturbing trend of fraud incidents involving cryptocurrency ATMs, particularly targeting vulnerable groups such as the elderly. Unlike conventional ATMs, these devices enable users to convert cash into Bitcoin and other digital assets. Fraudsters often impersonate authority figures or utility collectors, coercing victims into depositing cash into these kiosks. Once transferred, retrieving the digital assets becomes exceedingly difficult, leading to significant financial losses.

Amid a rising number of fraud reports nationwide associated with crypto ATMs, Albuquerque’s ban reflects broader concerns. The FBI has received over 13,400 complaints regarding these devices, with more than half coming from individuals over the age of 50.

National Implications of Local Action

As the primary federal agency investigating financial crimes and digital fraud, the FBI’s involvement underscores the potential for increased scrutiny of crypto kiosks not only locally but on a national scale. The volume of complaints signals potential for more extensive regulatory oversight across the United States.

Citing the direct role these kiosks play in fraudulent schemes, city authorities have mandated their complete removal.
