This upswing follows significant progress on the Digital Asset Market Clarity Act or CLARITY Act, a proposed comprehensive regulatory framework for cryptocurrencies in the U.S. after the White House reached a tentative ethics agreement.
Progress in Legislative Discussions?
The breakthrough resulted from collaborative efforts between White House officials and Republican figures like Senators Cynthia Lummis and Bernie Moreno, focusing on ethics clauses within the legislation. A White House representative characterized the agreement as “the most inclusive ethics provision to date.” Despite its passage in the House in July 2025, the CLARITY Act faces hurdles in the Senate, particularly over ethics concerns and protections for digital asset software developers.
Who Controls Enforcement?
At the core of the debate is the enforcement authority for ownership limitations of cryptocurrencies by public officials. Democratic lawmakers advocate for state prosecutors to manage this, wary of maintaining federal impartiality. The White House, alongside Senate Republicans, favors the federal attorney general assuming this role, an idea contested by Democrats who worry about executive influence.
Should it gain approval, the CLARITY Act will affect U.S. top political figures, reflecting on past associations of former President Trump with digital ventures like World Liberty Financial. Some Democratic senators have stressed that without sturdy ethical controls, the legislation falls short. The finalized ethical guidelines are still being awaited.
