In a significant move to reshape its digital asset regulatory landscape, Monaco has introduced Bill No. 1131, a legislative proposal to its National Council. This bill seeks to fortify the licensing framework for crypto service providers by introducing stringent governance and compliance guidelines. The initiative also aims to synchronize Monaco’s regulatory approach with the European Union’s MiCA regulation and FATF guidelines.

How Will Monaco Centralize Its Regulatory Oversight?

Monaco plans to implement a centralized supervisory mechanism through the CCAF, the principality’s financial regulatory body. Crypto-asset service providers will now require CCAF’s pre-authorization before initiating operations. This development moves away from Monaco’s divided approval strategy, consolidating it into a singular licensing process for digital asset entities.

The proposed legislation mandates evaluations by both the CCAF and the Autorité Monégasque de Sécurité Financière, ensuring financial and operational stability. The Agence Monégasque de Sécurité Numérique will also play a crucial role by assessing cybersecurity protocols to enhance operational safety.

Beyond initial approvals, this legislation will empower CCAF with ongoing oversight and enforcement capabilities over licensed crypto service providers. Government representatives anticipate that these measures will heighten compliance standards while substantially mitigating financial crime risks.

CCAF will conduct ongoing monitoring of licensed firms, aiming to reinforce regulatory compliance and to help protect Monaco’s finance sector against illicit activity.

Can Monaco Meet European and Global Regulatory Standards?

Yes, as the proposed law is fashioned closely after the EU’s MiCA framework. Although Monaco is not an EU member, this alignment will set standards for licensing and organizational governance akin to those required in the EU. The move is timely, given heightened international scrutiny regarding Monaco’s anti-money laundering efforts.
