US Politicians Press for Clearer SEC Stance on Ethereum-Based Financial Products

A group of Republican US lawmakers has confronted the Securities and Exchange Commission (SEC) regarding the regulatory treatment of Ethereum and related financial products. The legislators, including the heads of key financial committees, are seeking explicit guidance from SEC Chairman Gary Gensler on several issues affecting the cryptocurrency industry.

SEC’s Stance on Ethereum and Asset Custody Questioned

The lawmakers’ inquiry targets the SEC’s views on the custody of non-security digital assets by Special Purpose Broker Dealers (SPBDs), the regulatory classification of Ethereum (ETH), and the implications of recent announcements by the SEC regarding digital asset custody. The congressional members are concerned about the potential impact on the digital asset markets if the SEC’s policies remain ambiguous, specifically regarding the custody services for ETH by SPBDs under a regulatory framework that may not support such activities.

Concerns Over Crypto Classification and SEC Enforcement

The letter also highlights the SEC’s tendency to classify many cryptocurrencies as securities, which has resulted in confusion due to an unclear definition within the sector. The legislators criticize the Commission’s lack of clear guidance or rules for asset classification in the digital market, leading to uncertainty and numerous enforcement actions against digital asset trading platforms. These actions include accusations of operating without proper registration as brokers, clearing agencies, or national securities exchanges.

The legislators note that despite Ethereum’s widespread recognition as a non-security digital asset, the SEC has not provided a decisive classification for it, adding to the uncertainty. The SEC’s perceived reluctance to address these classification issues, particularly concerning Ethereum, has prompted the lawmakers to demand a clearer regulatory approach.

This move by US politicians indicates a pressing need for regulatory clarity in the rapidly evolving cryptocurrency landscape, as stakeholders seek to understand the rules and frameworks that govern their operations and investments in digital assets.
