Monaco is embarking on a significant transformation of its regulatory landscape concerning cryptocurrency service providers. The government has tabled a new legislative proposal aimed at scrapping the existing digital asset law introduced in 2022. The primary goal of the proposed Bill No. 1131 is to synchronize the principality’s framework with the European Union’s Markets in Crypto-Assets Regulation (MiCA), which aims to create a unified regulatory environment for crypto-assets across Europe.

If enacted, Bill No. 1131 would annul the previous structure that divided cryptocurrency services into distinct categories—issuance and operations overseen by Monaco’s State Minister, and investment services regulated by the Commission de Contrôle des Activités Financières (CCAF). The new law proposes a streamlined regulatory process, making the CCAF the primary authority for approving crypto-asset service providers. This shift seeks to foster a more cohesive and modern regulatory environment by aligning local laws with MiCA’s comprehensive standards.

How Will Regulations Enhance Security?

The draft bill stipulates stringent conditions that crypto firms must fulfill before gaining authorization, including thorough assessments by Monaco’s Financial Security Authority and the Digital Security Agency. This process aims to maintain high levels of financial and digital security. With a clear focus on mitigating financial crimes and money laundering, the legislation grants the CCAF the authority to monitor and take action against non-compliance.

Government officials asserted that stricter supervision and alignment with EU standards would help reduce financial crime while encouraging credible crypto business activity within the principality.

Monaco’s initiative also comes in response to its listing as a high-risk jurisdiction by the Financial Action Task Force (FATF) and the European Commission. Adopting MiCA-based regulations could provide the principality with tools to exit these lists, thus alleviating negative economic ramifications like slower international transactions and elevated compliance costs.
